Understanding Colorado's Statute of Limitations
In Colorado, you have a limited time to file a personal injury lawsuit. Missing this deadline means losing your right to seek compensation—forever.
General Personal Injury: 2 Years
For most personal injury claims, including car accidents, slip and falls, and other negligence cases, you have two years from the date of the injury to file a lawsuit.
Wrongful Death: 2 Years
Wrongful death claims must be filed within two years of the date of death.
Medical Malpractice: 2 Years
Medical malpractice claims have a two-year limit, but with a three-year maximum from the date of the act or omission.
Claims Against Government Entities: 182 Days
If your claim is against a government entity (city, county, or state), you must file a notice of claim within 182 days of the incident.
Exceptions to the Rule
- Minors: The clock doesn't start until the child turns 18
- Discovery rule: In some cases, the limit starts when you discovered (or should have discovered) the injury
- Defendant leaves state: Time may be paused if the defendant leaves Colorado
